Civil and Criminal Cases
A criminal case is brought by the government to determine whether a person committed a crime and, if convicted, what punishment applies. A civil case is brought by a person or entity seeking a legal remedy, often compensation or other relief. A survivor may have a civil claim even if no criminal charge was filed or no conviction occurred. Different parties, deadlines, evidence rules, and burdens of proof apply to the two systems.
