Comparative Negligence
Comparative negligence is a rule that reduces a plaintiff’s recovery according to the plaintiff’s share of fault. Some states allow recovery even when the plaintiff bears substantial responsibility, while others bar recovery above a specified percentage. Maryland generally follows contributory negligence instead of comparative negligence. Because the governing rule can change the outcome, the location of the incident and the law that applies are important.
