Contributory Negligence

Contributory negligence is a defense that can bar a plaintiff from recovering damages if the plaintiff’s own negligence contributed to the injury. Maryland generally follows this rule, subject to important legal doctrines and exceptions. The defense requires more than showing that the plaintiff could have been more careful. The facts must be evaluated under the applicable legal standard, including what the plaintiff knew and reasonably did at the time.
