Daubert Hearing
A Daubert hearing is a proceeding in which a court evaluates whether proposed expert testimony is sufficiently reliable and relevant to be admitted. The name comes from a United States Supreme Court case. Courts may examine the expert’s methods, data, testing, error rates, peer review, and fit with the issues in the case. The precise standard depends on the court and governing law. Expert-admissibility rulings can be especially important in drug, device, toxic exposure, and medical cases.
