Institutional Negligence
Institutional negligence is a claim that an organization failed to use reasonable care in protecting people under its supervision or control. In a sexual abuse case, alleged failures can involve screening, training, supervision, reporting, recordkeeping, responding to complaints, or enforcing safety policies. The claim requires proof of a legal duty, a breach, causation, and damages. Liability depends on what the institution knew or reasonably should have known and what it did in response.
