Negligence
Negligence is the failure to use the level of care that a reasonably careful person or organization would use under similar circumstances. A plaintiff generally must prove duty, breach, causation, and damages. The required level of care depends on the relationship and setting. Careless conduct without a resulting injury may not support a damages claim, and an injury by itself does not prove that anyone was negligent.
