Plaintiff

A plaintiff is the person or entity that brings a civil lawsuit. In an injury case, the plaintiff may be the injured person, a parent or guardian acting for a child, an estate representative, or a wrongful death beneficiary, depending on the law. The plaintiff has the burden to prove the required elements of the claim. Filing suit does not guarantee that the case will reach trial or result in a recovery.
