Standard of Care

The medical standard of care is the level and type of care that a reasonably competent health care provider would provide under similar circumstances. It depends on the patient, specialty, available information, clinical setting, and time. Guidelines and policies can be relevant, but they do not always define the legal standard by themselves. Qualified experts commonly explain the standard, whether the provider departed from it, and whether any departure caused injury.
