Toxic Tort
A toxic tort is a civil claim alleging injury from exposure to a harmful chemical, substance, or environmental condition. Examples can involve lead, asbestos, contaminated water, pesticides, or industrial materials. The plaintiff generally must identify the exposure, prove that it can cause the condition, show that it caused the individual injury, and establish a defendant’s legal responsibility. Dose, route, duration, latency, records, and alternative sources can be central.
