Vicarious Liability
Vicarious liability is legal responsibility imposed on one party for the conduct of another because of their relationship. An employer, for example, can sometimes be responsible for an employee’s wrongful act committed within the scope of employment. The rule does not apply to every worker or every act. Courts examine control, employment status, assigned duties, purpose, timing, location, and the governing jurisdiction.
