Defective Medical Device
A defective medical device is a device alleged to be unreasonably unsafe because of its design, manufacture, labeling, instructions, or warnings. Examples can include implants, surgical products, and diagnostic devices. A poor outcome or device failure does not automatically establish a legal defect. The investigation may examine the specific model, lot number, regulatory history, instructions for use, product testing, surgical records, and medical evidence linking the device to the injury.
