Duty of Care
A duty of care is a legal obligation to act with the level of care the law requires under the circumstances. Drivers owe duties to other road users. Property owners can owe duties to lawful visitors. Health care providers owe professional duties to patients. The existence and scope of a duty depend on the relationship, the risk, the jurisdiction, and the type of claim. A plaintiff must usually prove a duty before proving that it was breached.
