Failure to Warn

Failure to warn is a product liability theory alleging that a manufacturer or seller did not provide adequate instructions or warnings about a foreseeable risk. The claim can focus on the content, clarity, placement, timing, or intended audience of the warning. Drug and medical device cases can involve additional rules about warnings provided to prescribing health care professionals. A plaintiff must also prove the required connection between the inadequate warning and the injury.
