Negligent Retention
Negligent retention is a claim that an organization kept a person in a position after it knew or reasonably should have known that the person posed a relevant danger. In a sexual abuse case, evidence can include complaints, boundary violations, discipline, transfers, evaluations, warnings, and access to children or vulnerable people. The plaintiff must prove the applicable duty, unreasonable retention, causation, and damages under the governing law.
