Negligent Supervision

Negligent supervision is a claim that a person or organization failed to reasonably monitor or control someone whose conduct posed a foreseeable risk. In institutional abuse cases, the analysis may address staffing, access rules, one-on-one contact, complaints, training, policy enforcement, warning signs, and responses by supervisors. The existence of abuse does not automatically prove negligent supervision. The legal duty, notice, breach, causation, and damages must be established.
