Proximate Cause

Proximate cause is the legal connection between conduct and an injury that is sufficiently direct and foreseeable for liability. It is related to factual cause, which asks whether the injury would have occurred without the conduct. Courts state and apply proximate-cause rules differently. In complex injury cases, expert evidence may be needed to explain whether a breach of duty was a substantial and legally recognized cause of the harm.
