Punitive Damages

Punitive damages are intended to punish and deter especially wrongful conduct rather than compensate for the plaintiff’s loss. They are available only in limited circumstances and require proof beyond ordinary negligence. Maryland generally requires proof of actual malice under the applicable legal standard for tort claims. The availability, burden of proof, and any statutory restrictions depend on the claim and jurisdiction.
