The defects in a product may not be immediately evident or visible upon first use. Often, several reports of injury and unexpected malfunctions must take place before the dangers of a product are fully revealed.

If a toy has small parts that could cause choking and is not suitable for a child under the age of five, the toy’s packaging should state this, saying something like “Caution: small removable parts. Not suitable for children under 5”.
If a failure to warn about hazards causes physical injury, the victim may be able to file a product liability claim.
