Defective Products

The defects in a product may not be immediately evident or visible upon first use. Often, several reports of injury and unexpected malfunctions must take place before the dangers of a product are fully revealed.

In other cases, companies may release faulty items for sale or public use while being fully aware that the product could be dangerous to consumers.

Defective Product Liability

The problems found in defective products most often come from either:

  • A design defect; or
  • A manufacturing defect

In either case, the result is an unsafe product. If an unsafe product causes injury, responsibility can be laid at the feet of:

  • The product designer, which may not necessarily be the product manufacturer
  • The supplier of materials used in manufacturing the product
  • The manufacturer who assembled the product
  • The retailer who knowing sold an unsafe product

Failure to Warn

Product labeling and paperwork is the communication with consumers regarding use and potential hazards of a product. The product design may not be inherently “defective” but it could still be harmful if used in an inappropriate way. An example is the age range of children’s toys and games. If a toy has small parts that could cause choking and is not suitable for a child under the age of five, the toy’s packaging should state this, saying something like “Caution: small removable parts. Not suitable for children under 5”.

If a failure to warn about hazards causes physical injury, the victim may be able to file a product liability claim.
