FELA (Federal Employers’ Liability Act)

FELA

The Federal Employers’ Liability Act, or FELA, is a bill that was passed by Congress in 1906 and enacted in 1908 to protect railroad workers who were laboring to expand the rapidly growing network of railroad tracks across America during that time. It continues to serve the same purpose today. Every day there are train accidents that are caused in whole or in part by negligence on behalf of a railroad company and workers are receiving compensation through the FELA. However, unlike regular Workers’ Compensation, an employee must prove that the railroad company was at least in part responsible for the accident.

For this reason, many railroad employees need to hire a train accident lawyer to get the compensation they deserve. At first glance, the FELA is simple enough to understand, but due to the language used in the document, it can be (and has been) interpreted thousands of different times by different courts of law across the country. At the Yost Legal Group, we have attorneys that specialize in getting injured railroad workers the compensation they deserve through the Federal Employers’ Liability Act.

Benefits to Hiring an Attorney

The compensation that railroad employees receive through the FELA is often many times greater than compensation given out by Workers’ Compensation for non-railroad employees. For this reason, railroad employees have quite a bit more to lose if they misrepresent themselves in court or if they hire an attorney with little to no experience with the FELA. Not only will a qualified attorney have a better understanding of the Act, but they will also be able to interpret the document to make it have a better outcome in your favor. An experienced attorney will also be able to protect you from railroad company’s attorneys who will be trying to help to railroad.

Railroad Companies and the FELA

For the past century railroad companies have been trying, without success, to limit the reach of the FELA or simply have it repealed. Since then, many railroad companies have adopted the strategy of simply not paying out compensation even though the railroad company’s liability has been firmly established. They call this “starving out.” For this reason many railroad employees turn to law firm such as The Yost Legal Group to help them get the compensation payments they should have been awarded a long time ago.

If you are a railroad employee who has been injured in an accident on the job and you live in Baltimore, Maryland or surrounding areas, please contact the Yost Legal Group to speak with one of our experienced attorneys today.
