Earlier this year, The Yost Legal Group outlined the underlying factors of a Multidistrict Litigation (MDL) against the blood-thinner medication Xarelto. Since the announcement of this litigation at the end of 2014, a case that already appeared primed to become one of 2015’s largest mass tort drug cases has continued to grow as new patients harmed by this medication continue to come forward.
The case against Xarelto and manufacturer Janssen Pharmaceuticals, a subsidiary of Johnson & Johnson, centers on the fact that many patients felt they were not properly warned about the possible risks associated with taking this dangerous medication. In nearly all cases, claimants stated that the medication, which was intended to reduce blood clots and prevent strokes in patients with certain medical conditions, actually ended up causing uncontrollable internal bleeding.
Adverse Drug Reactions to Xarelto Include:
- Excessive Bleeding
- Red or Black Stools
- Frequent Nosebleeds
- Pink or Brown Urine
- Unexplained Bruises or Bruises that Increase in Size
- Coughing up Blood or Blood Clots
- Vomiting Blood or Vomit that Resembles Coffee Grounds
- Bleeding from the Gums
- Excessive Menstruation
To make matters worse, there is no known antidote for the serious and potentially deadly side-effects caused by Xarelto. While alternative anti-coagulant medications such as Warfarin can also increase the risk of bleeding problems in some patients, a vast majority of these problems can be treated through the use of Vitamin K and blood transfusions. Unfortunately, for patients experiencing similar side-effects from Xarelto, these techniques have proven to be ineffective. This has caused devastating and occasionally fatal consequences in many patients.
In December of 2014, a judicial panel ruled in favor of consolidating dozens of product liability claims against Xarelto and its manufacturers into one multidistrict litigation based out of the Eastern District Court of Louisiana. This action would allow all pending and future claims against Xarelto to be combined into one mass tort litigation, and would also encourage other patients harmed by the medication to come forward and seek compensation for their physical and emotional damages.
This technique of attracting new cases to the litigation against Xarelto appears to be wildly successful, as lawyers involved in the case are now reporting that they are adding five to ten new claims a week. Since the Multidistrict Litigation was announced in December of 2014, the number of cases against Xarelto has expanded from 21 lawsuits to nearly 200 product liability claims. In May of 2014, pharmaceutical manufacturer Boehringer Ingelheim announced a $650 million settlement in a similar anti-coagulant medication product liability case. The MDL against Xarelto and Janssen Pharmaceuticals may result in a similar or even larger settlement agreement when all is said and done.
