$4,000,000 HIE Birth Injury

    Mother had a full-term, uncomplicated pregnancy. She experienced an artificial rupture of membranes soon after arrival at Labor and Delivery. Mother experienced strong contractions occurring “back to back” until fetal heart rate was lost on the monitor. The medical team responded by searching for another monitor.  Only when the second monitor also detected no fetal heart rate was fetal distress diagnosed and an emergency c-section ordered. The delay resulted in the baby’s HIE brain injury with permanent, profound injury, including a seizure disorder. The case was settled before trial.
