Settlements & Verdicts
The following are results that we have achieved for actual clients. The facts of individual cases vary and these are not necessarily indicative of the value of another case. These results can be helpful to illustrate the experience of the team of lawyers at The Yost Legal Group.
$4,000,000 HIE Birth Injury
Mother had a full-term, uncomplicated pregnancy. She experienced an artificial rupture of membranes soon after arrival at Labor and Delivery. Mother experienced strong contractions occurring “back to back” until fetal heart rate was lost on the monitor. The medical team responded by searching for another monitor. Only when the second monitor also detected no fetal heart rate was fetal distress diagnosed and an emergency c-section ordered. The delay resulted in the baby’s HIE brain injury with permanent, profound injury, including a seizure disorder. The case was settled before trial.
$3,800,000 HIE Birth Injury
Mother had a full-term, uncomplicated pregnancy, which became an emergency c-section delivery due to prolonged fetal distress during labor. This resulted in an HIE injury, causing permanent brain damage to the baby. The parents were not initially informed about this by the medical team. The case was settled before trial.
$3,700,000 Cerebral Palsy Birth Injury
During pregnancy, the mother’s high blood pressure went untreated by the hospital, leading to the birth of an extremely premature infant. Tragically, this oversight resulted in the child suffering permanent, debilitating injuries of prematurity, resulting in a diagnosis of cerebral palsy. The case was settled before trial, underscoring the critical need for proper medical care and accountability.
$4,000,000 HIE Brain Injury
Mother had a full-term pregnancy without complications. The mother presented to Labor & Delivery when her water broke and was admitted. Several hours into labor, the baby’s heart rate pattern became worrisome and remained so for hours, but no c-section was performed. The decision not to perform a timely c-section resulted in causing an HIE brain injury, resulting in permanent, profound brain injury by the time the baby was delivered. The case was settled before trial.
$2,000,000 HIE Brain Injury During Delayed Delivery
The mother’s pregnancy was complicated by gestational diabetes, which caused the maternal-fetal medicine specialist to advise c-section delivery. However, OB/GYN determined an induced vaginal delivery was appropriate. The mother pushed for over 2 hours, followed by the OB/GYN attempting vacuum-assisted delivery, which failed, and the baby was ultimately pulled from the birth canal by the OB/GYN, blue and non-responsive. The baby suffered HIE brain injury during this delayed delivery and suffered permanent brain damage. The case was settled before trial.
$2,500,000 Cerebral Palsy Due to Brain Injury at Birth
Pregnancy was complicated by preeclampsia, which the doctor’s office diagnosed but did not immediately hospitalize the patient. This inaction resulted in critical distress to the mother and baby, requiring an emergency c-section and extensive NICU stay for the baby. The child consistently missed developmental milestones but whose cerebral palsy, due to brain injury at birth, was not diagnosed until several years later. The case was settled before trial.
