Labor Drug Pitocin Can Cause Birth Injury

It should be the happiest day in an expectant mother’s life. She has waited nine months and now it is time to meet her new baby boy or girl. Contractions induced by Pitocin will be longer and more forceful than a woman’s natural contractions, which can cause substantial stress to the baby possibly depriving the baby of oxygen and causing severe birth injury.

One study shows that babies born after the use of Pitocin are at three times greater risk of asphyxia, otherwise known as oxygen deprivation. Another study shows that babies born after the use of Pitocin were five times more likely to have brain damage.

Pitocin also has adverse effects on the mother as well. Pitocin can cause postpartum hemorrhaging and disrupt the process of naturally released hormones. Hormone disruption can lead to a diminished rate of breastfeeding.

Road Rage Incidents Can Lead to Deadly Results

Be Careful Swimming This Summer – Pool Safety Is Important

Last week, a man tragically lost his life when he drowned at the Maryland Beaver Dam Swimming Club. Unfortunately, this is a common event during the heat of the summer months, when men, women and children flock to pools and water parks to cool off.  It is important to follow all safety regulations when swimming in order to prevent these horrific accidents.

Beaver Dam Swimming Club has been the site of a number of drownings. In 2001, a 20-year-old man died in the water. And in 2002, the club was ordered to pay more than $700,000 to the family of a 24-year-old victim. The U.S. Consumer Product Safety Commission (CPSC) reports that nearly 400 children drown in a pool each year, with 75 percent of those incidents involving children younger than 5. According to the Center for Disease Control and Prevention, children between the ages of 1 and 3 and African-American children between the ages 5 and 19 are most likely to drown. The CPSC has initiated a Pool Safelycampaign. Pool Safely is a national public education effort to reduce drowning.

Stryker Rejuvenate and ABG II Modular Hip System Recall

Thousands of Americans receive hip replacements every year due to sports injuries, falls, aging and a host of other reasons. The goal of a hip replacement surgery is to return to your active lifestyle as quickly as possible. There are many different hip replacement medical devices on the market, from plastic implants to metal on metal implants.

Over the past decade, there have been a number of recalls on many of the top, name brand, metal on metal hip implant devises. It is the FDA’s duty to be the guardhouse for safe products, but sometimes defective products are passed through the system due to inadequate testing, manipulated reporting and of course, from human error.

Stryker is letting patients know that they should undergo a hip revision surgery to replace their metal on metal hip device for another model. Tractor Trailer Awareness Protects Drivers

A Howard County, Maryland resident was critically injured last week when his passenger vehicle collided with a tractor trailer on Interstate-70.  Unfortunately, tractor trailer accidents are not uncommon on our roadways.  For instance, did you know according to the Federal Motor Carrier Safety Administration (FMCSA) there has been a 20% increase in trucking accidents over the last two decades?

4)  Improper Loading:  A truck can malfunction when moving if the load is not safely configured or distributed on the trailer. Improper loading can also lead to not being safely secured, resulting in the load falling off onto roadways.

5)  Truck Driver or Company Selection:  Shippers need to be diligent in background checks on drivers and companies to ensure the best delivery results. They should check each are compliant with FMSCA regulations.

Massive Recall of Chevrolet Camaro Issued by General Motors

In the wake of this year’s earlier recall, General Motors scrambles as it issues another, this time for 2010 to 2014 Chevrolet Camaros.  Interestingly enough, this recall is due to similar issues as the previous malfunctioning ignition switch.

GM determined through internal testing, a result of the previous recall, drivers could move the ignition out the running position if drivers sit too close to the steering wheel and accidently bumped the key FOB with their knee.  Knocking the ignition out of running position will result in the loss of power, meaning the brakes and airbags would stop working, possibly resulting in a severe crash without the protection of standard issued safety gear.

General Motors issued a press release earlier today stating it is aware of three crashes that resulted in four minor injuries that it believes may be attributed to this new problem. More news about a negligent company with defective vehicles that can pose a serious threat to drivers and passengers.

What does this recall mean?  It means if you are the owner of a recalled current generation Camaro, you will be getting a new key.  The company will change the Camaro key to a standard design from one in which the key is concealed in the FOB and is opened by pushing a button.

The automobile enterprise announced that in all cases, customers will receive letters from GM letting them know when they can bring their car into a dealership, where the recall repairs will be performed for free and courtesy transportation will be provided as needed.

Nothing is Better Than a Ride Into The Sunset.

FDA’s Generic Drug Warning Labeling Rule Change

The New York Times recently published an editorial in support of the FDA’s generic drug labeling rule. AAJ (American Association for Justice) released an editorial board memo on generics and Katie Gommel (AAJ Press Secretary) did an outstanding job working behind the scenes with Public Citizen to shape this editorial.

Late last year, the Food and Drug Administration proposed new regulations  that would authorize the makers of generic drugs to update safety labels without waiting for F.D.A. approval, to warn of newly discovered risks. The change is strongly opposed by the manufacturers of generic drugs out of fear of being held liable for damages to patients harmed by their products. But the change is an important one, to give both patients and doctors more timely warning of possible risks and to enable patients to sue.

The current law, enacted in 1984, requires the labeling for a generic drug to be the same as the labeling already approved for the brand-name drug it had copied. The proposed rule change is important for two reasons. One is that a Supreme Court ruling in 2011 said that “because makers of generic drugs do not control the labeling, they cannot be sued under state law for failure to warn of new dangers”. So basically, patients could sue a brand-name drug manufacturer for such a failure, but consumers harmed by the generic version of the same drug were left without recourse. This important rule change would advocate consumer safety measures and allow both generic and non-generic drug companies to be held responsible for any adverse reactions.

The use of generic drugs account for 80 percent of all prescriptions filled in the United States today. Typically, once a generic drug enters the market, the brand-name drugs drop in popularity or disappear altogether; there are many generic drugs for which there is no brand-name drug still on the market whose label can be changed to indicate new risks.

With that in mind, the F.D.A.’s proposed changes would allow makers of generics to use the same process as brand-name drug makers to update safety information in the product labels. The F.D.A. is now considering a final rule.

The changes are strongly opposed by the Generic Pharmaceutical Association, a trade group, which argues that exposing makers of generics to product liability lawsuits will drive up their costs by at least $4 billion annually, increase the price of generic drugs, and cause confusion if different warnings are put on different versions of the same drug.

Public Citizen, a consumer advocacy group based in Washington that has been pushing the agency to make the change, believes there will be little or no confusion and suggests that the liability costs will not be large because prompt safety updates should help to prevent injuries from occurring in the first place.

Now that generics constitute the vast majority of prescriptions, their manufacturers should be made responsible for alerting the public to risks discovered after their drugs are on the market.

FDA to Review Rules for Over-the-Counter Drugs

The FDA has launched a review of the way it determines the safety of over-the-counter drugs such as acetaminophen. Current regulations allow the manufacturers of over-the-counter medications to drag their feet when it comes to updating warning labels.
